Last updated: 19 October 2026

At The Modern Company, we believe discretion is part of an exceptional service. This Policy explains, in plain terms, what personal data we collect when you visit our website or use our real estate advisory services, why we use it, how long we keep it and how you can exercise your rights.

1. Who we are

The controller of your personal data is TMCO., Unipessoal Lda ("The Modern Company", "TMCO", "we" or "us"), a real estate brokerage licensed under AMI no. 27832, tax number (NIPC) 519547675, with registered office at Avenida Santos Dumont, 46, 5.º D, 1050-204 Lisbon, Portugal.

For any privacy question, you can contact us at info@themoderncompany.pt or by phone on +351 218 700 821.

2. What data we collect

Data you give us

When you contact us through a property enquiry form, by email, phone or WhatsApp, we may collect:

  • your first and last name;
  • your email address and phone number, including WhatsApp;
  • your message and the property you are asking about;
  • your property preferences and investment criteria, if you share them with us;
  • the language in which you browsed the site, so that we reply in the same language.

We do not ask for identity documents, tax details or financial information through the website.

Data collected while you browse

  • Necessary technical data: for security and operational reasons, our hosting provider records your IP address, browser type and the pages requested.
  • Essential cookies: these remember your chosen language and your cookie decision.
  • Property maps: each property's location is shown as a map image provided by Mapbox, which receives your IP address to deliver it, without storing anything on your device.
  • With your consent: the interactive version of those maps. See section 8.

Data collected when a transaction goes ahead

If you go ahead with buying, selling or renting a property with us, the law requires us to identify our clients. At that stage, and only then, we will ask for details such as your identity document, tax identification number, address, occupation and information on the source of funds. This data is collected securely and never through website forms.

Data received from third parties

We may also receive your contact details from property portals or partners when you use them to enquire about a property we market.

  • Clients: for the duration of our relationship and then for the periods required by law. For example, client identification records are kept for 7 years and accounting records for 10 years.
  • Cookies: for the periods shown in section 8.

Once these periods end, the data is deleted or anonymised.

5. Who we share your data with

We never sell, rent or trade your data. We only share it with:

  • Service providers acting on our behalf and under our instructions:

    • our email delivery provider, for enquiry notifications;
    • Mapbox, property maps (the interactive version only with your consent).
  • Other parties to a transaction, such as the owner, the buyer, notaries, lawyers or banks, to the extent needed to complete the transaction you asked us to handle.
  • Public authorities, where required by law, including real estate supervisory bodies and tax and judicial authorities.

If you choose to talk to us on WhatsApp, that conversation is also processed by Meta under the service's own terms.

6. Transfers outside the European Union

Some providers, such as Mapbox, are based in the United States. In those cases, data is only transferred with appropriate safeguards: the EU-US Data Privacy Framework or standard contractual clauses approved by the European Commission. You can ask us for more information about these safeguards.

7. Security

The website uses an encrypted connection (HTTPS). Access to your data is limited to the team members who need it to assist you, and we keep regular backups. No system is infallible, but we review these measures regularly.
